1. Introduction
1.1 These Terms and Conditions govern the sale of hyperbaric oxygen chambers and related equipment (“Goods”) by oxygenhyperbarictherapy.uk (“we”, “us”, “our”) to you (“the Customer”, “you”). 1.2 By placing an order for a chamber through our website, you agree to be bound by these terms. 1.3 These terms apply to both consumer and business sales, though specific clauses (such as the right to cancel) may vary depending on your status as a consumer.
2. Technical Expertise & Pressure Management Support
Unique Service Provision: 2.1 Expert Guidance: Unlike standard retailers, we provide technical coaching on chamber operation and pressure equalization based on over 25 years of technical diving experience. 2.2 Scope of Advice: Our advice is strictly limited to the physical management of pressure (e.g., equalization techniques like the Valsalva maneuver, descent rates, and chamber protocols). This service is provided to ensure user comfort and help prevent barotrauma (ear pain) during use. 2.3 User Responsibility: While we provide expert coaching on how to clear your ears, you are responsible for monitoring your own comfort. You agree to halt the pressurization immediately if you experience pain. We are not liable for injury resulting from a failure to follow pressure equalization instructions or for forcing equalization against physical resistance (e.g., congestion).
3. Medical Disclaimer
3.1 Nature of Goods: We are a retailer of hyperbaric chambers. While Hyperbaric Oxygen Therapy (HBOT) is recognized for various wellness and recovery applications, we do not guarantee specific health outcomes or cures. 3.2 No Medical Advice: The technical guidance provided in Clause 2 relates solely to the mechanics of using the equipment safely. It does not constitute medical advice, diagnosis, or prescription. 3.3 Consultation Required: The use of our chambers should be approved by a qualified medical professional, particularly if the user has pre-existing conditions (e.g., lung conditions, ear problems, heart conditions, or pregnancy).
4. Orders and Contract Formation
4.1 All orders are subject to acceptance by us. After placing an order, you will receive an acknowledgement email; this does not constitute acceptance. 4.2 The contract is formed only when we dispatch the Goods or send a “Dispatch Confirmation” email. 4.3 We reserve the right to reject orders for high-value items if fraud checks fail, if stock levels are incorrect, or if we cannot fulfill the delivery.
5. Price and Payment
5.1 The price of the Goods will be as quoted on our website at the time of purchase. 5.2 VAT: Prices are inclusive of VAT unless stated otherwise. If you are eligible for VAT relief due to a disability or chronic illness, please contact us prior to purchase. 5.3 Payment must be made in full before dispatch. We accept major credit/debit cards and bank transfers.
6. Shipping and Delivery
6.1 Delivery Scope: Hyperbaric chambers are heavy freight items. Unless “White Glove Installation” is explicitly purchased, delivery is curbside only. You are responsible for moving the boxes into your property. 6.2 Lead Times: Delivery dates provided are estimates. We are not liable for delays caused by third-party couriers, customs clearance, or manufacturing delays. 6.3 Inspection: You must inspect the packaging immediately upon arrival. Any visible damage to the box must be noted on the delivery driver’s paperwork before signing.
7. Returns and Cancellations
7.1 Right to Cancel (Consumers Only): Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the Goods without giving a reason. 7.2 Hygiene & Health Exemption:
- To receive a full refund, the chamber must be returned in unused, original condition with all seals intact.
- Due to hygiene and health protection reasons, we cannot accept returns of oxygen masks, cannulas, or chambers that have been unsealed, inflated, or used, unless they are faulty. 7.3 Return Shipping: You are responsible for the cost of returning the Goods. Be aware that return freight costs for hyperbaric chambers can be substantial. We recommend using a tracked and insured service. 7.4 Restocking: We reserve the right to reduce your refund to reflect any reduction in the value of the Goods caused by your handling them beyond what is necessary to establish their nature, characteristics, and functioning.
8. Warranty
8.1 We provide a manufacturer’s warranty on the chamber and compressor against manufacturing defects. Please refer to the specific product page for the warranty duration. 8.2 Exclusions: The warranty does not cover:
- Damage caused by punctures from sharp objects (e.g., zippers, pet claws, jewelry).
- Damage due to improper voltage, power surges, or failure to change filters.
- Normal wear and tear. 8.3 Claim Process: To make a claim, please contact us at https://oxygenhyperbarictherapy.uk/contact-us/ with proof of purchase and photos/videos of the issue.
9. Safety and Prohibited Items
9.1 Fire Safety: Oxygen accelerates combustion. You must never take the following items inside the chamber:
- Lighters, matches, or vapes.
- Battery-operated devices (unless certified safe).
- Chemical hand warmers.
- Synthetic clothing (which causes static). 9.2 Strict Adherence: You agree to strictly follow the User Manual and our technical coaching regarding safety protocols.
10. Privacy and Data Protection
We value your privacy. Your personal information is stored securely and used solely for processing your order and providing customer support. For full details on how we handle your data, please refer to our Privacy Policy: https://oxygenhyperbarictherapy.uk/privacy-policy/
11. Limitation of Liability
11.1 To the extent permitted by law, oxygenhyperbarictherapy.uk shall not be liable for any indirect or consequential loss (including loss of profit) arising out of or in connection with the use of our Goods. 11.2 Nothing in these terms excludes our liability for death or personal injury caused by our negligence, or for fraud.
12. Governing Law
These terms are governed by English law. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
